Why Make a Will
In life you decide how you manage your assets and spend your money. In death, why should you allow the law to direct where these assets and money should go? By making a Will you will be deciding who receives all your possessions, property and other assets.
Would you want someone else to decide who your children should live with? If you haven't made a Will appointing a Guardian and you die while they are under 18 that's exactly what might happen.
You will undoubtedly wish to choose the person or people yourself who will administer your estate and, if you have children, invest their money on their behalf.
Who can make a Will?
You must be over 18 and have what is known as 'Testamentary Capacity' which means, simply, that you must know you are making a Will; you must be aware of what your assets and who your dependents are. If you or the person wishing to make a Will is disabled in some way, it may still be possible to make a Will but please let us know of any disabilities.
Why use Callaghans?
When you ask Callaghans to prepare your Will for you, you will be safe in the knowledge that, not only will it be drafted by solicitors who have spent many years training, but who are also members of the Society of Trust and Estate Practitioners (STEP) who have an additional qualification in the preparation of Wills and the administration of estates. The Law Society only recommends solicitors who are members of STEP to draft Wills. Solicitors are regulated and have to be insured, unlike Will Writers who are not members of the legal profession and are neither regulated nor insured if anything goes wrong.
